The issue of civil liability stemming from damages in banking services has been a recurring topic of discussion. The increasing sophistication of criminal methods targeting bank accounts, coupled with the insufficient enhancement of security measures by banks and a lack of public awareness to prevent exploitation by criminals, results in significant harm to banking service customers. The attribution of responsibility for compensating these damages becomes a matter of contention in the courts. Legal disputes include issues such as the criminal's responsibility, the bank's responsibility, joint responsibility of both parties, and responsibility based on establishing fault and the cause of the damage. In this context, there are general and specific laws, along with specific directives and jurisprudential rules, that determine civil liability arising from these damages. This paper focuses on phishing attacks on bank accounts while addressing the aforementioned legal disputes. The authors posit that the objective responsibility of banks in phishing cases is rooted in public funds and trade union requirements governing bank contracts, regardless of the availability of the primary culprit. The research methodology employed is descriptive-analytical, drawing on library sources.
